ABOUT AGRIVOLTAICS IN MAURITIUS

Understand with complete transparency the legal, fiscal and contractual aspects related to installing an agrivoltaic system on your land.

1 Who owns the solar installation?

The owner of the installation depends on the contractual arrangement chosen:

Personal Financing

You own 100% from the start.

Lease/Co-financing

The installation may belong partially or temporarily to an investor, with possible ownership transfer eventually.

2 Is a contract signed with the farmer?

Yes. Each project results in a written and signed contract, specifying:

  • the duration of land use (e.g.: 10 to 25 years)
  • the obligations of each party (maintenance, access, etc.)
  • income or benefits for the farmer
  • performance guarantees

3 Does my land remain agricultural?

Yes. Agrivoltaics is recognized as a full agricultural use.

The solar installation does not modify:

  • your land's agricultural purpose
  • its land status
  • your rights to subsidies or agricultural use

No subdivision, no land reclassification is imposed.

4 What are the guarantees for the farmer?

Each contract includes:

  • an electricity production guarantee based on PVGIS data
  • an agricultural non-interference clause (crops remain priority)
  • an early termination clause in case of force majeure
  • civil liability insurance included

5 Do I need a permit or official authorization?

In most cases, agrivoltaics on private land does not require a building permit, but may be subject to:

  • a simplified environmental authorization (depending on surface and power)
  • a declaration to CEB for grid injection (SSDG or Net Metering)
  • a landowner's agreement in principle if the land is rented

6 Is the electricity produced taxable?

Self-consumption

If you self-consume your production → no taxation.

Surplus Sale

If you sell surplus → income may be taxable according to your tax status.

Agrivoltaique provides you with an annual statement to submit to MRA if necessary.

7 What if I want to sell my land or terminate the contract?

You retain the right to:

  • sell your land at any time (with contract transfer to buyer)
  • terminate the contract according to planned conditions (exit clause)
  • buy back the installation at any time according to a predefined scale

8 Can I sign without going through a lawyer?

Yes. All contracts are written clearly, in French or English.
